GRETNA – A restaurant and its owners are being sued by their landlord for allegedly breaching a lease agreement.
N & K Inc. filed suit against Catelynn’s LLC, Thomas E. Wagner and Andrew Wagner in the 24th Judicial District Court on Nov. 19.
N & K Inc. claims tat on Feb. 24, 2014 Catelynn’s restaurant entered into a five-year lease agreement for property at 933 Behrman Highway, Suite A in Gretna. Rent was set at $3,400 per month for the first year to $4,133 per month for the fifth year of the lease, the suit says. The plaintiff alleges that included in the contract was a clause stipulating the payment of an additional $355 per month for shared facilities and its ability to levy late charges of $100 per month.
N & K Inc. contends that on Oct. 4, 2014, after being notified of back rent due, property insurance payments, property tax payments and utility payments due, Andrew Wagner posted a letter to the door of Catelynn’s notifying N & K Inc. to contact its attorney as well as returning the keys to the premises.
The defendant is accused of default and breach of lease.
An unspecified amount in damages to include all damages dues as well as attorney’s fees and legal costs is sought by the plaintiff.

The case has been assigned to Division O Judge Ross P. LaDart.
