Deckhand claims knee injury, sues over trip and fall aboard shipping vessel

GRETNA – A deckhand is suing his employer for injuries he claims to have received in a trip and fall on a commercial shipping vessel.

John Gary Miller filed suit against Marquette Transportation Company LLC and M/V Golden Eagle in the 24th Judicial District Court on Dec. 10.

Miller claims that he was working aboard the M/V Golden Eagle on Dec. 6, 2013 when he tripped over a wire protruding from the ship’s deck as he was carrying a load of chains. The plaintiff alleges that due to the incident he has received severe and disabling injuries to his left leg and knee.

The defendant is accused of failing to provide crew with a safe place to work, failing to maintain the vessel, failing to maintain a seaworthy vessel, failing to exercise due care, failing to prevent the accident, failing to warn and disregarding the safety of others.

An unspecified amount in damages is sought for physical pain and suffering, medical expenses, mental anguish, lost wages, loss of earning capacity and loss of enjoyment of life.

Miller is represented by Robert J. Caluda of Metairie-based The Caluda Law Firm.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.

Case no. 745-016.
