Concordia Lutheran School sued after student allegedly hit in the face by another student with a padlock

GRETNA – The parents of a student attending Concordia Lutheran School are suing after the girl allegedly had to undergo medical treatment and plastic surgery to repair damage caused by another student hitting her in the face with a padlock.

Gerald Matherne and Marlene Sisto, individually and on behalf of their minor daughter, filed suit against Concordia Lutheran School, Concordia Lutheran School Association and Guide One Insurance Company in the 24th Judicial District Court on Dec. 15, 2014.

Matherne and Sisto contend that on Dec. 16, 2014 their daughter was a student at Concordia Lutheran School when she was hit in the face with a padlock by another student. The plaintiffs assert that the incident resulted in their daughter receiving a severe laceration to her face that required 10 stitches and plastic surgery to repair. Matherne and Sisto claim that following the incident the defendants refused to discuss the alleged attack and attempted to conceal the nature of the events that resulted in her injuries. Further, the plaintiffs allege that they believe the school has video of the incident, but have failed to turn it over to them.

The defendants are accused of failing to take precautions to prevent the injury, failing to provide proper supervision, failing to advise plaintiffs of the damages to their daughter, failing to monitor the children in a proper and safe manner and failing to train the supervisor to protect the child from harm.

An unspecified amount in damages is sought for suffering, disability, medical expenses, disability, anxiety, concern, loss of function, mental anguish, emotional distress, lost wages, diminished earning capacity, special care and services, loss of enjoyment of life and permanent partial disability.

Matherne and Sisto are represented by attorney Zoe Olivia Fleming of Gretna.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
