Dillard University renovation project contractor sued by subcontractor for alleged non-payment

GRETNA – A construction company is being sued by a subcontractor for allegedly not paying for labor and materials furnished for renovation of a building on the campus of Dillard University.

The Ellis Company LLC filed suit against Gibbs Construction LLC and Western Surety Company in the 24th Judicial District Court on Jan. 6.

The Ellis Company contends that on Aug. 9, 2012 Gibbs Construction entered into a contract with Dillard University to renovate the Camphor and Hartzell residence halls on campus. The plaintiff asserts it was subcontracted by the defendant to provide labor and materials for waterproofing and masonry work on the project. In addition, the Ellis Company claims Gibbs Construction requested they complete other various duties not included in the contract for which they made change orders that were added to its eventual bill of services performed.

While the Ellis Comply claims it has completed all obligations on contract and submitted all invoices, Gibbs Construction has refused to pay what is owed.

The defendant is accused of breach of contract.

Damages in the amount of $270,316.34 plus attorneys fees, courts costs and legal interest are sought by the plaintiff.

The Ellis Company is represented by Kari A. Bergeron of Baton Rouge-based Taylor, Porter, Brooks & Phillips LLP.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.
