Homeowners sue contractor, subcontractor over flooding of new home

GRETNA – Homeowners are suing several companies they say are responsible after their home was  flooded.

Brain and Bridget Branch filed suit against KSK Plumbing & Mechanical LLC, Paradise Pools and Spas Inc., Hallmark Specialty Insurance Company and Godbold Construction Company LLC in the 24th Judicial District Court on Jan. 7.

The Branches claim they contracted Godbold Construction Company to construct a home for them located at 282 Walter Road in River Ridge. KSK Plumbing & Mechanical LLC allegedly was subcontracted to install plumbing lines and fixtures at the home, but that it failed to connect the water lines and cap off water pipes at their home.

Additionally, the plaintiffs contend that Paradise Pools and Spas was contracted to install a swimming pool at their home and when they turned on the outside water valve, water flowed into their home due to KSK Plumbing & Mechanical failing to properly cap the water pipes.

The plaintiffs assert that due to the incident several of the rooms in there home received water damage.

The defendants are accused of failing to properly cap the water line, failing to take steps to prevent water damage, failing to notify that the water pipe was uncapped, failing to shut off water to the home, failing to warn of the danger, failing to take steps to avoid the incident and failing to connect the water line.

An unspecified amount in damages is sought for loss of use of property, loss of enjoyment of property, loss of movable goods, diminution in value of property, repair and remediation expenses, mental anguish, attorney’s fees and costs of litigation.

The plaintiffs are represented by Stephen M. Huber of New Orleans-based Huber, Slack, Thomas & Marcelle LLP.

The case has been assigned to Division O Judge Danyelle M. Taylor.
