GRETNA – A tenant is suing his landlord alleging he was injured in a fall in an apartment he was leasing.
Oliver Ducre Jr. filed suit against Altobello Family Properties LLC and Real Estate Showcase LLC in the 24th Judicial District Court on Jan. 15.
Ducre contends that on May 20, 2014 he was leasing an apartment from Altobello Family Properties and Real Estate Showcase when he was exiting his room and tripped on a piece of buckled carpeting causing him to fall to the floor. The plaintiff asserts that prior to the incident the plaintiffs without success had attempted to fix the carpeting several times.
The defendants are accused of failing to properly inspect and maintain the carpet, failing to earn tenants of the hazard, failing to maintain the apartment in a reasonably safe condition, failing to use ordinary care in the maintenance of the apartment, failing to take necessary precautions to avoid incidents and failing to correct a defect.
An unspecified amount in damages is sought for mental pain and anguish, physical pain and suffering, medical expenses and loss of enjoyment of life.
Ducre is represented by Nancy S. Silbert of New Orleans-based Wolfe, Begoun & Pick LLC.
The case has been assigned to Division O Judge Danyelle M. Taylor.
Case no. 745-880.
