GRETNA – A nursing home resident is suing after he allegedly broke his hip in a fall out of his bed.

Ronald Eugene Rudolph filed suit against Maison De’Ville Nursing Home of Harvey LLC in the 24th Judicial District Court on Jan. 27.

Rudolph claims that after suffering a stroke over a decade ago he has been paralyzed on one side of his body and has been a nursing home resident for several years. The plaintiff alleges that when he was living at Maison De’Ville Nursing Home of Harvey located at 2233 8th St. in Harvey he fell two times and had a history of falling in other nursing homes he had stayed at previously. On Oct. 30, 2012, Rudolph contends he fell out of his bed at Maison De’Ville because his guardrails were not up.

The plaintiff asserts he was severely injured in the incident, receiving a fractured hip that had to be corrected through surgery.

The defendant is accused of failing to properly review all records regarding the plaintiff’s previous falls, failing to conduct fall risk assessment, failing to have bed rails in a raised position and failing to properly keep records regarding the fall.

An unspecified amount in damages is sought for medical expenses and physical pain and suffering.

Rudolph is represented by attorney James Maher II of New Orleans.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
