Boathouse owners sued by guest allegedly injured in fall through hole in bathroom floor

GRETNA – The owners of a boathouse and their property insurer are being sued after a guest was allegedly injured after falling through a hole in their bathroom floor severely injuring her knee in the process.

Lynette Robinson, and husband Edward, filed suit against Markel Insurance Company and Terry Hebert and Jodi Hebert in the 24th Judicial District Court on Jan. 21.

Robinson alleges that on Feb. 1, 2014 she was an invited guest aboard a houseboat owned by the Heberts located on Jean Lafitte Highway in Lafitte. The plaintiff contends that when she went into the darkened bathroom of the boathouse she fell into an open hole in the floor. Robinson asserts she was severely injured in the incident for which she had to undergo surgery to repair a torn meniscus and ACL in her knee. The plaintiff claims that due to the mishap she missed a significant amount of time for the Terrebonne Parish School Board as a custodian and cafeteria worker.

The defendant is accused of not ensuring there were not broken holes into floor, inviting a guest into an area without ensuring its safety, failing to light the boathouse and failing to take necessary and proper precautions to ensure safety.

An unspecified amount in damages is sought for pain and suffering, lost wages and medical expenses.

Robinson is represented by Harold J. Lamy of New Orleans-based Barker, Boudreaux, Lamy & Foley.

The case has been assigned to Division E Judge John J. Molaison Jr.
