Couple sued for allegedly defaulting on home elevation payments

GRETNA – A home elevation company is suing a couple they claim defaulted on a contract to elevate their home and still owes thousands of dollars.

Levco LLC filed suit against Herman Price and Patricia Price in the 24th Judicial District Court on March 9.

Levco alleges the Prices own a home located at 2108 Fernando Court in Marrero that it was contracted to elevate with part of the funds for the job provided by the Office of Community Development Disaster Recovery Unit Hazard Mitigation Program and the Road Home Program. The plaintiff contends the contract with the defendants was signed on March 14, 2012 for a total cost of $130,000 of which the defendants were personally responsible for repaying $30,000 in monthly installments of $88.33 until the amount had been paid off. However, Levco asserts the Prices stopped making payments and as of Sept. 15, 2014 had missed 20 consecutive months.

The plaintiff claims they sent a request for the defendants to pay $2,897.50 to become current on the payment, but they have failed to do so.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought by the plaintiffs.

The case has been assigned to Division O Judge Danyelle M. Taylor.
