Cart caravan collides with Wal-mart customer, leading to lawsuit

A Jefferson Parish resident has sued Walmart, alleging premises liability.

Rossanette Daniels filed a complaint April 22 in the U.S. District Court of the Eastern District of Louisiana April 22, against Wal-Mart of Louisiana, citing premises negligence in a May 2014 incident.

According to the complaint, on May 15, 2014, Daniels was shopping at a Wal-Mart Supercenter Store, 5110 Jefferson Highway, Harahan, when she attempted to retrieve a shopping cart and was struck from behind by a train of shopping carts being pushed by a Wal-Mart employee.

The suit says Daniels suffered injuries including but not limited to her right hip right leg and back. Daniels alleges neglect on the part of the defendant in failing to maintain a proper lookout, yield right-of-way to customers, control the carts, follow established procedures or exercise reasonable care.

The plaintiff cites: past and future medical expenses; pain and suffering, mental anguish, and emotional distress; disability; and loss of ability to enjoy life’s pleasures.

Daniels seeks compensatory damages of $300,000, attorney fees, expenses and costs.
