Home elevation company claims couple missed payments for 22 months on $30K debt

Breach of contract

GRETNA – A home elevation company is suing Marrero homeowners saying they stilll owe $30,000 for an elevation job.

Levco LLC filed suit against Zina Fobb and Lionel Fobb in the 24th Judicial District Court on March 9.

The plaintiff contends that on March 30, 2012 it entered into a contract with the Fobbs to elevate their home located at 2034 Rue Racine in Marrero at a cost of $126,803.84. Levco asserts that all but $30,000 of the home elevation cost was covered by a state grant and the balance of the job would be repayable by the Fobbs at $88.33 per month with zero interest until the entire $30,000 had been paid off.

However, the plaintiff claims the defendants have failed to make payments on their debt and as of Sept. 15, 2014 they were 22 months behind.

The defendant is accused of breach of contract.

Damages in the amount of $2,933.26 plus attorney’s fees are sought by the plaintiff to bring the defendant’s payments up to date.

Levco is represented by James F. Ryan of Metairie-based Donovan & Lawler.

The case has been assigned to Division A Judge Raymond S. Steib Jr.

Case no. 747-532.
