GRETNA – Jefferson Parish property owners are suing their neighbor who they claim will not remove property from a lot which has held them up in constructing a home on the site.
Pamela Bernard and Blaine Bernard filed suit against Philomela Hefler in the 24th Judicial District Court on March 25.
The Bernards assert they are the owners of a property located at 904 Newman Ave. in Jefferson where they were preparing to build a home. The plaintiffs claim when they surveyed the construction site they found an adjoining property owned by Hefler located at 902 Newman Ave. in Jefferson was encroaching on the rear of their property. The Bernards allege they were cited for code violations by Jefferson Parish for not constructing a barrier around their property, however, they maintain they were not able to construct such a barrier due to the encroachment of Hefler’s property onto their property.
The Bernards contend they contacted Hefler several times asking her to remove the encroachment, but she has failed to do so and that by allowing it to remain the development of their property is not possible due to safety hazards and non-compliance with parish code.
The defendant is accused of encroaching on the plaintiff’s property.
An unspecified amount in damages is sought for fines, attorney’s fees and contempt charges.

The case has been assigned to Division F Judge Michael P. Mentz.
