GRETNA – A local retailer is being sued by a customer who claims she received disabling injuries when merchandise struck her after falling from a display.
Marionne Celistan filed suit against Pier 1 Imports Inc. and its insurer in the 24th Judicial District Court on March 25.
Celistan contends that on March 26, 2014 she was shopping at the Pier 1 Imports store located at 1629 Westbank Expressway in Harvey when merchandise fell onto her from a display. The plaintiff asserts she sustained severe and disabling injuries over her entire body in the incident.
The defendant is accused of failing to keep a proper lookout, failing to properly secure its premises, failing to properly secure the display, failing to avoid the incident, failing to maintain the premises, operating the premises in a careless and reckless manner, failing to use reasonable vigilance, improperly stacking products and vicarious liability.
An unspecified amount in damages is sought for medical expenses, neurosis, pain and suffering, emotional trauma, mental anguish, property damage, loss fuse of property, lost wages and lost warning capacity.

The case has been assigned to Division F Judge Michael P. Mentz.
