GRETNA – A local waste company is suing a transmission service that it claims negligently repaired a truck, which later caught fire and was completely destroyed.
Waste Management of Louisiana LLC filed suit against Al-Trans Service Inc., Bill Bayhi, National Trust Insurance Company and FCCI Insurance Company in the 24th Judicial District Court on April 2.
The plaintiff alleges that on April 3, 2014 it sent a 2007 Mack front-loading garbage truck that was having transmission problems to Al-Trans Service Inc. Waste Management of Louisiana contends Bayhi, working on behalf of Al-Trans Service Inc., replaced a wiring harness on the truck and after a test drive further work was done on the repair including changing the location of the wiring. The plaintiff asserts that after the repairs the truck was parked inside their Harvey facility over the weekend when it caught fire at 4:30 a.m. on April 6, 2014 and was completely destroyed.
The defendant is accused of negligence, breach of contract and products liability.
An unspecified amount in damages is sought for property damage, loss of use, fire damage, judicial interest and litigation costs.
Waste Management of Louisiana is represented by Stephen T. Perkins of New Orleans-based Taylor, Wellons, Politz & Duhe APLC.
The case has been assigned to Division C Judge June Berry Darensburg.
