GRETNA – A woman is suing a couple she claims she sold her home to in 1999 with the promise they would make cash payments to her, but still owe $64,000 on the property and have only ever made one payment.
Gail Greenberg filed suit against Thomas V. Cortez Sr. and Lisa Greenberg Cortez in the 24th Judicial District Court on April 2.
In 1999, Greenberg claims she entered into contract to sell her home located at 5208 Irving in Metairie to the defendants for $189,000. The plaintiff alleges the Cortezs were unable to fully finance the sale through their bank and only received a loan for $110,000. Greenberg contends she went through with the sale with the understanding that the defendants would pay off the remaining $79,000 directly to her. However, the plaintiff maintains the Cortezs have only paid $15,000 that came from the business account of Thomas V. Cortez Sr. at TRC Electric. Greenberg assert the defendants still owe her $64,000.
The defendant is accused of breach of contract.
Damages in the amount of $64,000 is sought by the plaintiff.
Greenberg is represented by attorney James Casey Fos of Covington.
The case has been assigned to Division H Judge Glenn B. Ansardi.
