Fitness center tenant sued by local mall over alleged $13K breach of contract

GRETNA – A local mall is suing a former tenant it claims breached a lease agreement.

Esplanade Mall Limited Partnership filed suit against Jerry Gros and Next Level Sports Performance and Fitness Center in the 24th Judicial District Court on April 8.

The plaintiff claims Gros and Next Level Sports Performance and Fitness Center entered into a lease agreement beginning Aug. 1, 2012 with a monthly cost of at least $1,500 for a commercial space in the mall located at 1401 W. Esplanade in Kenner.

Esplanade Mall Limited Partnership alleges the defendants opened a fitness center in the mall and extended the initial 28 month lease agreement by nearly three years. However, the plaintiff contends shortly after signing the extension Gros and Next Level Sports Performance and Fitness Center failed to make payments on the lease and vacated the property on Feb. 13, 2015 owing $13,584.13 in overdue rent.

The defendant is accused of breach of contract.

Damages in the amount of $13,584.13 is sought by the plaintiff.

Esplanade Mall Limited Partnership is represented by A. Gregory Grimsal of New Orleans-based Gordon, Arata, McCollum, Duplantis & Eagan LLC.

The case has been assigned to Division C Judge June Berry Darensburg.
