A construction company is suing over claims it has not been paid for work done on five projects.
Ellis Construction Services (ECS) filed a lawsuit against Woodrow Wilson Construction, LLC of Baton Rouge in U.S. District Court of the Eastern District of Louisiana on May 18, 2015, citing breach of contract in a construction agreement.
The suit claims ECS contracted with Woodrow Wilson to construct five separate residences in eastern Louisiana for a total amount of $376,728.00. The suit states that ECS supplied labor and materials in the amount of $84,586.68 and that the defendant failed to pay despite ECS demands.
The suit alleges that in the interest of completing the project, ECS incurred additional out-of-pocket expenses for which it did not bill the defendant. ECS claims that consequently it was impoverished, while Woodrow Wilson Construction was unjustly enriched at the plaintiff’s expense.
The suit seeks actual damages in the amount of the unpaid invoice(s) plus penalties; pre- and post-judgment interest; and attorney’s fees, expenses and court costs. ECS is represented by Craig Kaster and Teresa Cop of Kaster & Cop, LLC in Zachary.
