Retailer sued after clothing racks allegedly fell on, injured child

BATON ROUGE – A grandmother is suing a popular clothing store claiming her granddaughter was severely injured after clothing racks fell on top of her.

Aisha Peters filed suit against It’s Fashion Metro, a division of Cato Corporation, in the 19th Judicial District Court on April 10.

According to court records, Peters and her granddaughter were shopping at the store in Kenner on April 1 when the incident happened. The plaintiff asserts that her granddaughter was severely injured, including a broken finger, and ended up in the hospital.

The defendant is accused of failure to inspect the store for hazardous racks, failing to keep customers out of harm’s way and failing to properly follow rules in customer safety.

An unspecified amount in damages is sought for medical expenses, physical disability, physical pain, mental pain and suffering.

Attorney Stephen M. Smith of New Orleans represents the plaintiff.

The case has been assigned to Division I Judge R. Michael Caldwell.
