Insurance company sued for allegedly violating state law, failing to provide proper payment for insurance claim

GRETNA – An insurance company is being sued for allegedly failing to provide proper payment for a Marrero client’s property damages from a severe hailstorm.

John Perry filed suit against Lighthouse Property Insurance in the 24th Judicial District Court.

Perry asserts that he purchased a property insurance policy from Lighthouse Property Insurance Corporation for his home located at 1032 Carmadelle St. in Marrero. The plaintiff claims the policy was in effect when a severe hailstorm struck the area on Feb. 24, 2013 and damaged his home. Perry alleges that his home’s roof was damaged in the storm which further allowed water intrusion that damaged the strict and contents.

However, the plaintiff contends after he submitted a claim to Lighthouse Property Insurance Corporation it sent out an insurance adjuster who did not spend enough time at his home to properly assess the damages. Subsequently, the plaintiff asserts the defendant underpriced their damages and failed to provide a proper and adequate insurance claim payment.

The defendant is accused of breach of contract, bad faith claims handling, negligent claims handling, breach of good faith, non-prompt payment, violation of state law and negligent misrepresentation.

Damages in excess of $50,000 is sought for the amount of the loss, 50 percent of the difference between the amount paid and the actual amount due, an additional award for special damages not to exceed $5,000 and attorney’s fees.

Perry is represented by Tiffany R. Christian of New Orleans-based Binegar Christian.

The case has been assigned to Division C Judge June Berry Darensburg.
