A Jefferson Parish worker is suing his former employer, alleging it refused to honor his benefits following a workplace injury.
Troy Dakin filed a lawsuit June 22 in U.S. District Court for the Eastern District of Louisiana against Reinhart Foodservice, alleging breach of duty after a May workplace accident resulted in personal injuries that prevented him from returning to work.
According to the complaint, on May 15, Dakin, who was employed by Reinhart, suffered a work injury, sought medical help and reported the incident to his employer the same day. The suit states after the plaintiff filed a workers' compensation claim May 19, Reinhart retaliated against him by terminating his employment by the end of the month.
The lawsuit contends that Dakin was entitled to 12 weeks of FMLA benefits and alleges the company’s actions were in violation of federal and state labor law. The suit states the defendant was in breach of duty by denying lawful benefits to its worker.
Dakin seeks liquidated and monetary damages, wages, salary and all benefits, plus attorney fees, expenses and court costs. He is represented by attorney Timothy Richardson of Usry, Weeks & Matthews in New Orleans.
