Tow truck company sues claiming new truck engine failed, manufacturer breached warranty

GRETNA – A tow truck company is suing a truck manufacturer after a truck it purchased allegedly suffered major engine defects that could not be fixed.

Pro Tech Collision Center LLC and Green Acres Towing filed suit against Navistar Inc. and International Truck and Engine Co. in the 24th Judicial District Court on May 19.

Pro Tech Collision Center asserts that on Oct. 12, 2012 it purchased a new tow truck from Navistar Inc. and International Truck and Engine Co. for $64,450. The plaintiff claims that afterwards the engine failed and the defendants were unable to properly meet its warranty by repairing it. Pro Tech Collision Center alleges the tow truck is now worthless.

The defendant is accused of breach of warranty.

An unspecified amount in damages is sought for loss of use, loss of income and attorney’s fees.

Pro Tech Collision Center is represented by attorney Michael R. Delesdernier of Metairie.

The case has been assigned to Division C Judge June Berry Darensburg.
