Business brings employee to court alleging inappropriate claim to public works project

A St. Tammany parish contracting company filed suit against its employee, a North Carolina resident, regarding an alleged claim the defendant made in 2014 potentially infringing on the plaintiff’s gains.

Three Deuces Inc. sued Zeno Lancaster of Gastonia, N.C., in the U.S. District Court of the Eastern District of Louisiana on June 29, alleging that Lancaster wrongfully filed a claim to profits on a contract belonging to his employer in September 2014.

The suit states that Three Deuces was awarded a public works contract to repair, clear and drain the St. John the Baptist Canal and provides filing details.

According to court documents, the defendant received W-2 wages for his work under Three Deuces’ employ but wrongfully filed a lien on or about Sept. 24, 2014, alleging that he was a subcontractor and supposedly entitled to $193,444.52.

Asserting that Lancaster is prohibited from filing a lien against the public works project, Three Deuces seeks declaratory action to find the lien null and void; and that no funds are due to the defendant. Stating that the amount of controversy exceeds $75,000 and involves parties of different states, the plaintiff requests that the U.S. District Court of the Eastern District of Louisiana handle the matter as it falls within the court’s jurisdiction.
