Wal-Mart customer sues, claiming injury after two liter of soda fell on foot

GRETNA – A local Wal-Mart is being sued by a woman who claims she was injured when a two liter fell off a shelf and landed on her foot.

Patricia Batiste filed suit against Walmart Harahan Supercenter #1353, Martin Family Private Holdings Lp and their insurer in the 24th Judicial District Court on May 26.

Batiste contends on May 24 she was shopping for groceries at the Wal-Mart located at 5110 Jefferson Hwy. in Harahan when a two liter of soda fell off a shel and landed on her foot. The plaintiff asserts she suffered serious injuries in the incident to her foot and left ankle that have required continuing medical care.

The defendant is accused of failing to properly maintain its shelves, knowing of the hazard and not preventing the incident.

An unspecified amount in damages is sought for medical expenses, injuries to various body parts, physical pain and suffering, lost wages and loss of earning capacity.

Batiste is represented by attorney James P. Johnson of New Orleans.

The case has been assigned to Division J Judge Stephen C. Grefer.
