Sports training website sues web developer for nearly $50K over alleged problems

GRETNA – The owner of a sports training website is suing a web developer for nearly $50,000 for alleged breach of contract.

Sports Trainer Index LLC filed suit against K-FX2 Inc. in the 24th Judicial District Court on May 29.

Sports Trainer Index LLC contends it is the owner of a website launched on May 14  that offers a matching service for athletes and trainers to allow them to coordinate and plan sports training. The plaintiff asserts that after identifying the need for a custom, well-designed website including a “shopping cart” for online purchases it contracted K-FX2 Inc. in 2013 to build such a website for $9,775. Sports Trainer Index claims it further paid another $12,500 when the defendant identified the need to build a new platform for the web design.

The suit says that on May 6, 2014 K-FX2 Inc. allegedly told Sports Trainer Index LLC the website had been completed to specifications and further contracted for $21,000 to create a profile system for the website’s users. However, Sports Trainer Index LLC alleges it soon discovered after the website’s launch that K-FX2 Inc. failed to meet the stipulations laid out in the contract and the website was incomplete and has not functioned properly. On Dec. 4, 2014 Sports Trainer canceled the contract for further work and employed other web developers for costly work to fix the website. 

The defendant is accused of bad faith breach of contract and misrepresentation.

An unspecified amount in damages is sought for the return of $43,275 in service charges for work on the website and $1,560 in fees for outside contractor to fix the website in addition to legal fees.

The case has been assigned to Division H Judge Glenn B. Ansardi.
