GRETNA – A condo association is being sued by a resident for allegedly not repairing a roof and running afoul of the Americans With Disabilities Act.
Elihu Lucas filed suit against Audubon Trace Condominium Association in the 24th Judicial District Court on June 4.
Lucas alleges he owns a condominium in the Audubon Trace Condominium Association. The plaintiff contends he made multiple complaints to the defendant over several years concerning a leaky roof, but the roof was never repaired. Lucas asserts that due to the continuing leak his ceiling has been damaged and led to a termite infestation that has decreased the property’s value. The plaintiff claims the Audubon Trace Condominium Association turned off the water supply to his unit causing him to live in unsanitary, unsafe conditions.
In addition, Lucas alleges he is permanently disabled and requested Audubon Trace Condominium Association to install a wheelchair ramp, hand rails and install a dedicated handicapped parking space for use by the disabled. The plaintiff contends the defendant has failed implement policies to comply with the Americans With Disabilities Act and as a result he has suffered several falls causing disabling injuries to his foot, neck, back and knees.
The defendant is accused of breach of contract and violating the Americans With Disabilities Act.
An unspecified amount in damages is sought for mental anguish, pain and suffering, loss of enjoyment of life, diminution of value and expenses for displacement relocation.

The case has been assigned to Division H Judge Glenn B. Ansardi.
