Contractor sues over alleged injuries in fall from balcony

BATON ROUGE – An independent contractor is suing a local subdivision claiming work site injuries.

David Gayden filed suit against Westhaven LLC and Bilwood Smith Real Estate Incorporated in the 19th Judicial District Court on April 22. 

According to the suit, the plaintiff was hired as an independent contractor to paint one of the defendant’s properties located at 10167 Bonnet Cove Ave. Gayden claims that while he was painting he fell through the balcony flooring where it was rotten. The plaintiff contends that he was severely hurt as a result. 

The defendants are accused of not knowing of this unsafe condition and failing to do anything about it, failing to warn the plaintiff of a hazardous condition and failing to adequately inspect the property. 

As a result of the accident, the plaintiff claims he suffered numerous injuries to his back, neck, ankle and right arm.

An unspecified amount in damages is sought for body damages, medical expenses and court fees.

Attorney Michael C. Palmintier of Baton Rouge is representing the plaintiff.

This case has been assigned to Division E Judge William A. Morvant.

Case no. 638,783.
