Casino sued by woman who claims she swallowed broken glass from beer bottle

GRETNA – A casino is being sued by a patron who claims she swallowed glass from a broken beer bottle.

Gaffney Matherne filed suit against Treasure Chest Casino LLC, Treasure Chest Casino and two unknown employees in the 24th Judicial District Court on June 16.

Matherne claims on June 17, 2014 she was a patron at the Treasure Chest Casino in Kenner. The plaintiff alleges she ordered a bottled beer from a Treasure Chest Casino employee who brought it to her from the bar after it was opened by an unknown bartender. Matherne contends when she went to take a drink of the beer she glass got down her throat, which she unsuccessfully tried to cough up. Only after she took the drink and the incident occurred, did the plaintiff say that another casino patron pointed out to her that the bottle’s neck had been broken.

The plaintiff asserts that as a result of the incident she had to undergo surgery to determine if pieces of glass were embedded in her digestive system.

The defendant is accused of creating a dangerous condition, failing to properly inspect the bottle, negligently serving a dangerous bottle, violating applicable laws and regulations, failing to see what should have been seen and failing to exercise reasonable care.

An unspecified amount in damages is sought for physical pain and suffering, mental anguish, medical expenses, loss of enjoyment of life and lost wages.

Matherne is represented by Kenneth J. Deroche Jr. of Metairie-based Bernard, Cassisa, Elliot & Davis.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
