Neighbors sues for disability after neighbor’s dog allegedly bites arm

GRETNA – A man is suing his neighbors after he allegedly was attacked by their dog while cutting his grass. 

Charles McLoughlin filed suit against William Fraser, Sally Fraser and their insurer in the 24th Judicial District Court on June 22.

McLoughlin asserts he was cutting grass at 704 N. Woodlawn Ave. in Metairie where the alleged incident happened. 

He claims that as he came close to a fence separating his property from his neighbor's, one of the Fraser’s dogs violently jumped across the fence and bit his left arm. 

The defendants are accused of failing to secure their dog, failing to exercise proper duty of care, failing to observe a hazard, failing to observe due caution, inattention and failing to observe reasonable care.

An unspecified amount in damages is sought for physical pain and suffering, physical disability and loss of enjoyment of life.

McLoughlin is represented by attorney Max J. Koeck IV of Metairie.

The case has been assigned to Division O Judge Danyelle M. Taylor.
