Couple sued by contractor for $51K

GRETNA – A contracting company is suing a pair of homeowners and their insurer for allegedly not fully paying for work done to repair their fire damaged property.

B&G Construction & Restoration Inc. filed suit against Scott Gautreaux and Nicole Gautreaux and Wells Fargo Home Mortgage Inc. in the 24th Judicial District Court on June 25.

B&G Construction & Restoration Inc. claims that on Aug. 14, 2014 it entered into a contract with the Gautreauxes in the amount of $141,501.04 to work on their home located at 1933 Bonnie Ann Drive in Marrero. The plaintiff alleges the work on the home was necessitated by a fire that damaged the property. B&G Construction & Restoration Inc. contends that the Gautreauxes’ insurer would approve the repairs to the home and then issue a check in the name of B&G Construction & Restoration Inc., Scott Gautreaux and Nicole Gautreaux and Wells Fargo.

The plaintiff alleges the Gautreauxes have accepted the work as completed and are currently living in their home, but have failed to endorse checks in the amount of $51,948.22 needed to pay for work done on the property.

The defendant is accused of breach of certification.

Damages in the amount of $51,948.22 is sought for the principal amounts die, interest, general damage and attorney’s fees.

B&G Construction & Restoration Inc. is represented by Stanwood R. Duval of Houma-based Duval, Funderbunk, Sundberry, Lovell & Watkins.

The case has been assigned to Division P Judge Lee V. Faulkner Jr.

Case no. 751-056.
