Waste management company sued over injuries after garbage truck backs into woman's parked car

GRETNA – A waste management company is being sued by a woman who claims she received disabling injuries when one of the garbage trucks backed into her vehicle while she was sitting in it in a parking lot.

Christian Nata filed suit against Progressive Waste Solutions of LA Inc. and Dana Marie Carter in the 24th Judicial District Court on July 2.

Nata claims that on Aug. 4, 2014 she was sitting in her 2000 Mazda MPV parked in the parking lot of an apartment complex located at 3324 Neyrey Drive in Metairie when a 2010 Mack garbage truck owned by Progressive Waste Solutions and driven by Carter backed into her vehicle. The plaintiff alleges she suffered personal injuries in the incident.

The defendant is accused of reckless operation of a motor vehicle, failing to exercise proper caution, failing to maintain a proper lookout, failing to take evasive actions and failing to maintain control of the vehicle.

Damages in excess of $50,000 are sought for pain and suffering, disability, mental anguish, medical expenses and loss of income.

Nata is represented by Val Patrick Exnicios of New Orleans-based Liska, Exnicios & Nungesser.

The case has been assigned to Division M Judge Henry G. Sullivan Jr.
