Couple accuses Forest River, Dixie Motors of selling leaking Leprechaun boat

NEW ORLEANS – A Louisiana couple say the approximately $60,000 recreational boat they purchased leaks and has other defects in materials and workmanship and should have been repaired under warranty.

Gerald A. and Jacqueline B. Grosch filed a lawsuit Nov. 17 in U.S. District Court for the Eastern District of Louisiana against Forest River Inc., Dixie Motors and Bank of America, citing breach of implied and express warranties and negligent repair.

According to the complaint, despite the plaintiffs returning their Leprechaun boat to the defendants numerous times for repairs, the boat still was not safe for use. Under Louisiana redhibition laws, the plaintiffs claim they are entitled to return the boat to the defendants for a full refund.

Bank of America, the lender for the boat’s purchase, is named as a defense against the debt, the suit says. The boat's purchase price was $57,259.

The Grosches seek a jury trial and damages of more than $75,000, plus litigation costs and cancellation of the sales contract. They are represented by Mandeville attorney Richard C. Dalton.
