NEW ORLEANS – Two Louisiana women say their former employer, H2O Hair, owes them for unpaid wages.
Carrie Biggio and Chelsea Luminais filed a class action lawsuit Nov. 18 in U.S. District Court for the Eastern of Louisiana against H20 Hair Inc., Michael John Gaspard and Holli M. Gaspard, alleging violations of the Fair Labor Standards Act. The defendants' unnamed insurance company is also being sued.
According to the complaint, when Biggio and Luminais worked for the defendant’s salon, they were often required to work more than 40 hours a week, but were not paid overtime. Upon their complaints to the defendants about the wages, the suit says they were threatened with termination, denied access to clients and other alleged retaliations to be proven at trial.
The plaintiffs seek a jury trial, punitive damages, reimbursement for lost wages and attorney’s fees. They are represented by New Orleans attorney Kenneth C. Bordes.
