Dispute over termite damage brings insurer, insured to court

NEW ORLEANS – A Florida-based insurance company is seeking a declaratory judgment a customer in a dispute involving termite damage.

Southern Fidelity Insurance Co. (SFIC) filed a lawsuit Dec. 23 in U.S. District Court for the Eastern District of Louisiana against Shannon Y. Rodriguez.

According to the complaint, Rodriguez filed a claim with SFIC on May 22 concerning a collapse and other damage caused by termites to her proprty. SFIC claims the defendant’s policy only covers insect damage if it causes a collapse, rather than other harm to the property. The suit also seeks the court’s determination of what constitutes a collapse. This information is needed to resolve a dispute between the appraisers representing both parties about the amount of the claim.

SFIC seeks declaratory relief and damages. It is represented by attorneys Matthew D. Monson and Donald J. Latuso Jr. of The Monson Law Firm LLC in Mandeville.
