Physical therapy firm accuses Madison Parish Hospital of contract breach

Overdue

MONROE – A Mississippi physical therapy firm is suing Madison Parish Hospital in a dispute involving payment for contracted services.

Mid South Rehab Services Inc. filed a lawsuit Jan. 15 in U.S. District Court for the Western District of Louisiana, Monroe Division, against Madison Parish Hospital, alleging breach of contract.

According to the complaint, both parties signed a 36-month agreement on March 15, 2011, whereby Mid South managed the hospital’s therapy program and provided physical, occupational and speech therapy to Madison Parish Hospital’s patients. The suit says that although Madison Parish told Mid South they did not want to renew shortly before the contract's expiration, they did not give the required 90 days' notice as specified in the contract. As a result, the plaintiff claims they were not paid for the final two months in which they provided services.

Mid South seeks damages of more than $75,000, including the final two months of the contract, lost profits, interest and litigation costs. It is represented by attorney David D. Kervin Jr. of the Law Office of David D. Kervin Jr. LLC in Covington.
