Shopper accuses Dollar Tree Stores of negligence over allegedly broken toilet seat

NEW ORLEANS – A St. Tammany Parish woman says she fell and injured her head in the Covington Dollar Tree store’s restroom.

Lynn Maffei and her husband, Vincent Maffei, filed a lawsuit Jan. 15 in U.S. District Court for the Eastern District of Louisiana against Dollar Tree Stores Inc., alleging negligence.

According to the complaint, Lynn Maffei was shopping in the Dollar Tree store on Jan. 21, 2015. When she proceeded to use the women’s restroom, the toilet seat allegedly suddenly shifted off the toilet, causing her to fall against the wall and strike her head. As a result of the mishap, Maffei suffered injuries to the cervical and lumbar areas of her back, as well as her head, the complaint states.

The Maffeis seek general and equitable relief, pre- and post-judgment interest and litigation costs. They are represented by attorneys Thomas A. Gennusa II, Joseph S. Piacun and Jeffrey S. Gennusa of Gennusa, Piacum & Ruli in Metairie.
