NEW ORLEANS – A Denham Springs company says Capital Coatings applied paint to a barge that later began to flake off.
River City Towing Services Inc. filed a lawsuit Jan. 21 in U.S. District Court for the Eastern District of Louisiana against Capital Coatings and Linings Inc., alleging negligence, breach of contract and breach of warranty of workmanlike performance.
According to the complaint, River City Towing hired Capital Coatings on Nov. 29, 2014, to perform blast cleaning repairs and repaint cargo tanks aboard its RCT9 barge. Subsequently, the suit says the paint Capital Coatings applied to the surface of the barge linings began to flake and peel, rendering it unusable. As a result, River City alleges that it removed the barge from service and incurred significant expenses for repairs.
River City seeks a jury trial and recovery of expenses for barge repair and litigation, as well as cancellation of the $67,127 invoice. It is represented by attorneys Jefferson R. Tillery and Marc Hebert of Jones Walker LLP in New Orleans.
