Hearing-disabled man claims discrimination in interview process

BATON ROUGE – A hearing-disabled man is suing a Baton Rouge business and a Houston business, alleging failure to accommodate his disability during a pre-employment physical evaluation.

Tavid Norman filed a lawsuit on Oct. 16, 2015, in the U.S. District Court for the Middle District of Louisiana against Performance Energy Services LLC and Quanta Services Inc., citing violation of the Americans with Disabilities Act.

According to the complaint, Norman was given a conditional employment offer from the defendant on Nov. 5, 2013, if he passed a pre-employment physical. The plaintiff submitted to a hearing test but was allegedly not allowed to use his hearing aids while taking the test, causing him to fail.

After the test, Norman claims that he was rejected for the position and was informed by the supervisor in a derogatory manner that it was due to his disability. The plaintiff avers that the defendants did not accommodate for his disability and that he would have been able to pass the pre-employment test with his hearing aids, thereby constituting a violation of the ADA.

Norman seeks declaratory judgment against the defendant regarding their alleged violations of the ADA; damages including back pay, front pay, nominal, compensatory and punitive damages; costs, attorney’s fees and expenses. He is represented by Gregory J. Miller in Baton Rouge.
