Driver alleges Alabama man caused crash

LAFAYETTE – A Lafayette woman alleges an Alabama man caused an accident in Lafayette Parish that caused her injuries.

Shayla S. Gotch filed a complaint on April 18 in the U.S. District Court for the Western District of Louisiana, Lafayette-Opelousas Division against Owners Insurance Co., Auto-Owners Insurance Co., Joe Scott & Associates Inc. and Randall Jay McClung alleging that defendant McClung failed to operate the vehicles in a safe manner.

According to the complaint, the plaintiff alleges that on May 7, 2015, she was a driving a 2010 Honda Civic traveling south in the far left lane on NW Evangeline Thruway. On that same date, the suit states that McClung was driving a 2004 Chevrolet Silverado and was also traveling southbound in the center lane when he attempted turn left into her path, causing an accident. She alleges the incident resulted in serious injuries to her head, back, neck, right shoulder, arms and body.

The plaintiff holds Owners Insurance Co., Auto-Owners Insurance Co., Joe Scott & Associates Inc. and McClung responsible because McClung allegedly negligently operated the vehicle, failed to maintain a proper lookout, failed to yield before changing lanes, traveled at an excessive rate of speed and failed to take evasive action in order to avoid a collision.

The plaintiff requests a trial by jury and seeks compensation for damages, plus interest, all cost of these proceedings and any further alternative relief as the law and equity may allow. She is represented by Joseph F. Gaar Jr., Jason Matthew Welborn, Lucas S. Colligan and Jacob Houston Hargett of Gaar Law Firm in Lafayette.
