Georgia man allegedly injured from taking Xarelto

NEW ORLEANS – The representative of a deceased Georgia man alleges her decedent suffered serious side effects as a result of taking Xarelto.

Pelatyah Hawkins, as personal representative of the estate of Walter Bean Sr., deceased filed a complaint on April 18 in the U.S. District Court for the Eastern District of Louisiana against Janssen Research & Development LLC, Janssen Ortho LLC, Janssen Pharmaceuticals Inc., Bayer Healthcare Pharmaceuticals Inc., et al. citing negligence, breach of express warranty and other counts.

According to the complaint, the plaintiff alleges that Walter Bean Sr. began using Xarelto on or about Feb. 24, 2014, up through approximately March 12, 2014. As a direct and proximate result of the use of Xarelto, the decedent allegedly suffered serious and dangerous side effects including life-threatening bleeding, as well as other severe and personal injuries that were permanent and lasting in nature. He also allegedly suffered physical pain and mental anguish, diminished enjoyment of life, hospitalization and medical expenses.

The plaintiff holds the defendants responsible because the defendants allegedly designed, researched, manufactured, tested, advertised, promoted, marketed, distributed and sold Xarelto; failed to properly investigate, research, study and define the safety profile of the drug; failed to adequately test it; failed to provide adequate warnings; failed to disclose the need for dose adjustments;  and failed to provide adequate instructions.

The plaintiff requests a trial by jury and seeks compensation for damages in excess of the jurisdictional amount, prejudgment and post-judgment interest, reasonable attorneys’ fees and costs and such other and further relief as the court may deem just and proper.
