Family accuses U.S. government of causing father's death

NEW ORLEANS — Two sons are suing the U.S. government, alleging medical malpractice caused their father's death.

Daniel Forrest Jr. and Kevin C. Forrest of Louisiana filed a lawsuit April 20 in U.S. District Court for the Eastern District of Louisiana against the United States of America, alleging negligence, carelessness and malpractice in failing to notify the family of their father's abnormal test results.

According to the complaint, on June 9, 2014, Daniel M. Forrest Sr. came to the VA Medical Center and Clinics in Hammond for a cardiology appointment. He had previously undergone series of medical examinations at Tulane University Heart and Vascular Institute and Westbank Clinic, the suit says.

 On June 19, 2014, the lawsuit states, results of an abnormal test were faxed to Hammond VA Clinic but neither Forrest nor his wife received the notice. Forrest died in sleep June 26, 2014, the complaint says. 

The plaintiffs allege the U.S. government failed to provide appropriate action in response to Forrest's positive nuclear stress test result and failed to diagnose and treat his cardiac condition, significantly contributing to his untimely death.

The Forrests seek a trial by jury, judgment of $1.1 million, costs of suit and such other and equitable relief as the court deems proper. They are represented by attorney Benjamin Mouton of McGlynn, Glisson & Mouton in Baton Rouge.
