Tuna Taxi owner alleges two false liens were filed against it

NEW ORLEANS – A marine vessel owner alleges that two liens were wrongfully filed against it.

RSDC Holdings LLC filed a complaint on April 22 in the U.S. District Court for the Eastern District of Louisiana against M.G. Mayer Yacht Services Inc. seeking judgment that the Tuna Taxi is not subject to the liens.

According to the complaint, the plaintiff alleges that it contracted the defendant to repair the bridge of the Tuna Taxi. Upon completion of the repair work, the suit states the defendant released the Tuna Taxi to its owner and filed a false lien with the National Vessel Documentation Center of the U.S. Coast Guard dated March 18, 2013, in the amount of $31,805.75. Defendant allegedly also filed a second false lien dated Aug. 5, 2013, in the amount of $4,588.60.

The plaintiff alleges the false liens have put a cloud on the title of the Tuna Taxi and impairs its use and marketability. The plaintiff holds M.G. Mayer Yacht Service Inc. responsible because the defendant allegedly did not perform any of the repairs alleged to be performed within the liens, failed to cancel the liens and continued to refuse to release the liens from the Tuna Taxi.

The plaintiff requests a trial by jury and seeks declaration that the Tuna Taxi is not subject to any liens, award of costs and attorney's fees and such other and further equitable relief as the court may deem reasonable and just under the circumstances.
