MONROE — A home health caregiver is suing her employers alleging failure to pay minimum wage.
Margarite Sampson Brown of Louisiana, filed a class action lawsuit, individually and on behalf of all those similarly situated June 10 in U.S. District Court for the Western District of Louisiana Monroe Division against Body & Soul Services, Inc., Derenda Flowers and Sheila Green, alleging failure to comply with the U. S. Department of Labor regulations, including the Fair Labor Standards Act.
According to the complaint, Brown did not receive overtime wages in a timely manner and has not received an equal amount of liquidated damages due to late payment of overtime wages through Feb. 6.
The plaintiff alleges the defendants deprived her of the federally mandated minimum wage for each hour worked, refused to pay for travel time, mandatory work meetings and for any hours worked in excess of eights hours per day, or 40 hours per week, and failed to maintain proper time records.
Brown seeks a trial by jury, declaration the defendants' actions are in violation of the FLSA, awarding of an amount equal to the federal minimum wage rate for all hours worked for and an amount equal to one and one-half of their hourly rate for all hours worked in excess of 40 per week, liquidated damages, reasonable attorney fees and legal costs.
