Customer blames Winn-Dixie for injuries

NEW ORLEANS — A St. Tammany Parish woman is suing Winn-Dixie, alleging their negligence caused her to fall at one of the defendant's stores.

Nicole L. Warren filed a lawsuit July 21 in U.S. District Court for the Eastern District of Louisiana against Winn-Dixie Stores Inc., Winn-Dixie Stores Leasing LLC, Victory Real Estate Investments LLC and Massachusetts Bay Insurance Company, doing business as The Hanover Insurance Company, alleging negligence in failing to maintain a public area safe for customers.

According to the complaint, on Aug. 18, 2015, while Warren was shopping at a Winn-Dixie store in Mandeville owned by the defendants, she slipped in a puddle of water. This slip and subsequent fall to the floor caused her to sustain severe and disabling injuries, suffer mental and physical pain, lost wages and medical expenses. 

The plaintiff alleges the defendants failed to maintain the condition of the store, failed to warn Warren of a hazardous condition within the store, failed to block off the area in which the accident occurred and failed to provide the proper standard of care to its customers.

Warren seeks a trial by jury, judgment of $5 million, legal interest, all legal costs and all equitable relief. She is represented by attorneys Thomas M. Discon, Charlotte Discon Strief and Scott Discon  of Discon Law Firm in Mandeville.
