Consumer accuses collection agency of harassment

NEW ORLEANS — A New Orleans woman is suing a collection agency, alleging abuse, intentional infliction of emotional distress and invasion of privacy.

Toni Campbell filed a complaint July 28 in U.S. District Court for the Eastern District of Louisiana against Diversified Recovery Bureau LLC, alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, in February 2016, Campbell started to receive calls from Diversified Recovery, attempting to collect an alleged debt. Despite Campbell's request for the defendant to stop calling her, the suit says, she continues to receive collection calls, causing her to be harassed and annoyed. 

The lawsuit states Campbell was financially damaged for incurring charges for incoming calls. The plaintiff alleges the defendant made calls using an automatic telephone dialing system and without her prior express permission. The defendant's calls were not for emergency purposes, the suit says.

The plaintiff seeks a trial by jury, statutory damages of $1,000, treble damages, injunctive relief prohibiting such conduct in the future, and all relief the court deems appropriate. He is represented by attorney Samuel J. Ford of Varadi, Hair & Checki LLC in New Orleans.
