LAFAYETTE — A Louisiana man is suing an Illinois company, alleging failure to pay proper overtime.
James Gibbs of Natchitoches filed a lawsuit Aug. 5 in U.S. District Court for the Western District of Louisiana Lafayette Division against Foresite Realty Partners LLC of Rosemont, Illinois, alleging violation of the Fair Labor Standards Act.
According to the complaint, Gibbs was a full-time employee who worked about 100 hours a week as a property maintenance worker. The suit says he worked seven days per week and remained on call 24 hours per day.
However, the lawsuit states, he was not paid one and one-half times his regular rate for all hours worked more than 40 each week as required by FLSA. The plaintiff alleges Foresite Realty failed to properly pay regular and overtime compensation.
Gibbs seeks trial by jury, full amount of unpaid wages and overtime work, reasonable attorney fees, legal costs, expenses and all other relief.
