Welder accuses labor contractor of failing to pay proper overtime

Late 03

LAFAYETTE — A St. Mary Parish man is suing his former employers, alleging failure to pay overtime wages.

Gregorio Vasquez Ramirez filed a lawsuit Aug. 9 in U.S. District Court for the Western District of Louisiana Lafayette Division against Contractor Labor Services LLC and Eduardo Hernandez,  alleging violation of the Fair Labor Standards Act.

According to the complaint, during Ramirez's employment as a welder with Contract Labor from 2014 to July, 2016, he did not receive additional wages at the rate of one and one-half times his rate for all hours worked in excess of 40 per week as required by FLSA.

The plaintiff requests a trial by jury, accumulated wages at the overtime rate as required by law, an equal sum of liquidated damages, attorney fees, interest and costs of this proceeding. He is represented by attorneys Daniel B. Davis and Randall E. Estes of East Davis Law LLC in Baton Rouge.
