NEW ORLEANS – A hotel room attendant has filed a class-action lawsuit against two Metairie employers over allegations of unpaid overtime.

Kiyoko Rubio filed a complaint on behalf of all other persons similarly situated in the U.S. District Court for the Eastern District of Louisiana against C.R. Contractors LLC, SGS LLC and Maritza Romero alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she normally worked more than 40 hours a week without receiving proper overtime compensation. The plaintiff holds C.R. Contractors LLC, SGS LLC and Romero responsible because the defendants allegedly treated her as exempt from overtime requirements and never paid her at a rate of one-and-half times her regular rate for all hours worked in excess of 40 in a workweek.

The plaintiff requests a trial by jury and seeks an order certifying this case as a collective action, compensation for all unpaid overtime wages due, enjoining defendants from violating FLSA’s wage provisions, attorneys’ fees and costs, prejudgment and post-judgment interest and such other equitable relief. She is represented by Roberto Luis Costales and Emily A. Westermeier of Costales Law Office in New Orleans and William H. Beaumont of William H. Beaumont Law in New Orleans.
