Cigna & Life Insurance Co. of North America accused of wrongfully terminating benefits

NEW ORLEANS – A St. Charles Parish woman alleges her disability benefits were wrongfully terminated.

Kathleen Rainey filed a complaint in the U.S. District Court for the Eastern District of Louisiana against Cigna & Life Insurance Co. of North America alleging that they violated the Employment Retirement Income Security Act.

According to the complaint, the plaintiff alleges that between May 2013 and August 2015, she received disability benefits from the defendant. On Aug. 24, 2015, she alleges she received a notice from defendants that her benefits were being terminated. The plaintiff holds Cigna & Life Insurance Co. of North America responsible because the defendants allegedly terminated her benefits under the employee welfare benefit plan even though she is still disabled and ignored the findings of the independent medical exam she received.

The plaintiff requests a trial by jury and seeks payment of all long-term disability benefits past due, reinstating her disability insurance benefits, pre- and post-judgment interest, attorney fees and expenses and for any other relief that may be equitable.
