Deckhand alleges he was injured on the job after vessel collision

NEW ORLEANS – A Terrebonne Parish man alleges he was injured when the vessel he was working on collided with another vessel.

Brett Drake filed a complaint in the U.S. District Court for the Eastern District of Louisiana against T & M Boat Rentals LLC, Mr. Spotty LLC and Erin W, in rem alleging unseaworthiness.

According to the complaint, the plaintiff alleges that on Nov. 28, 2015, he was employed by defendant and was in his bunk bed when defendant's vessel Erin W collided with another vessel, causing him to be thrown from his bunk bed and sustain serious injuries that resulted in mental anguish, lost earnings, pain and suffering and medical expenses. The plaintiff holds T & M Boat Rentals LLC responsible because the defendant allegedly failed to maintain the vessel safe and reasonable state of repair, failed to take reasonable precautions for its crews' safety and breached its non-delegable duty to provide him with the benefits of maintenance and cure.

The plaintiff requests a trial by jury and seeks compensation for actual damages, plus prejudgment and post-judgment interest, punitive damages, attorney's fees, costs and all other relief to which he may be entitled. He is represented by Walter Naquin Jr. of Naquin Law Firm in Thibodaux.
