Man claims Keystone RV is defective, has not been repaired

BATON ROUGE – A consumer claims a recreational vehicle he purchased is defective and seeks a rescission of the sale contract.

Jeffrey O. Eldridge filed a complaint on Sept. 10 in the U.S. District Court for the Middle District of Louisiana against Keystone RV Co., Southern RV LLC and U.S. Bank NA alleging that they violated the Magnuson-Moss Warranty Act and other counts.

According to the complaint, the plaintiff alleges that on May 23, 2015, he purchased a new 2015 Keystone Carbon Model 33 from Southern RV. When delivered, the suit states the Carbon RV was defective in materials and workmanship in regards to the air conditioning unit, with such defects being discovered within the warranty periods. The plaintiff alleges he suffered damages including but not limited to diminution in value of the vehicle, loss of use and loss of wages. The plaintiff holds Keystone RV Co., Southern RV LLC and U.S. Bank NA responsible because the defendants allegedly failed to repair the vehicle so as to bring it into conformity with the warranties and failed and refused to repair or repurchase the defective vehicle.

The plaintiff requests a trial by jury and seeks judgment against the defendants for all damages, rescission of sale, out-of-pocket damages, prejudgment and post-judgment interest, attorney fees, costs and all other relief the court deems appropriate.
